This agreement ("Agreement") governs your access to and use of the mobile and web application ("Employee Link") provided by Magnify Technologies ("Company"). By accessing or using Employee Link, you agree to be bound by this Agreement. If you do not agree to these terms and conditions, you may not access or use Employee Link.


1. Account Registration


1.1. In order to use Employee Link, you must register for an account by providing accurate and complete information as requested by Magnify Technologies. You are responsible for maintaining the confidentiality of your account login credentials and are solely responsible for any activities or actions taken under your account.

1.2. You agree to provide true, accurate, current, and complete information during the registration process and to update such information to keep it accurate and complete.

1.3. Magnify Technologies reserves the right to suspend or terminate your account if any information provided by you is found to be false, inaccurate, misleading, or incomplete.


2. Employee Link Usage and Restrictions


2.1. Employee Link is designed to track employee work hours, manage schedules, facilitate team communication, and assist with job labor management. You agree to use Employee Link only for lawful purposes and in compliance with all applicable laws and regulations.

2.2. You shall not use Employee Link in any manner that could damage, disable, overburden, or impair its functionality or interfere with any other party's use and enjoyment of Employee Link.

2.3. You shall not attempt to gain unauthorized access to Employee Link or any part thereof, including any user accounts or systems connected to Employee Link.

2.4. You acknowledge that Magnify Technologies may collect and use certain information about your usage of Employee Link in accordance with Magnify Technologies' Privacy Policy.


3. Intellectual Property Rights


3.1. Employee Link and all intellectual property rights therein, including but not limited to copyrights, trademarks, trade secrets, and patents, are and shall remain the exclusive property of Magnify Technologies.

3.2. You are granted a limited, non-exclusive, non-transferable, and revocable license to use Employee Link solely for the purposes outlined in this Agreement. You shall not modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on Employee Link.

3.3. You shall not remove, alter, or obscure any proprietary notices or labels on Employee Link or any portion thereof.


4. Disclaimer of Warranties


4.1. Employee Link is provided "as is" without any warranty of any kind, whether express or implied. Magnify Technologies does not guarantee the accuracy, reliability, or completeness of any information provided by Employee Link.

4.2. Magnify Technologies disclaims all warranties, whether express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement.


5. Limitation of Liability


5.1. To the maximum extent permitted by applicable law, Magnify Technologies shall not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses, arising out of or in connection with your use or inability to use Employee Link.

5.2. In no event shall Magnify Technologies' total liability to you exceed the amount paid by you, if any, for accessing or using Employee Link.


6. Indemnification


6.1. You agree to indemnify, defend, and hold harmless Magnify Technologies, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees).


7. Data Access


7.1. Employees will retain access to their personal data stored within the system, even in the event of removal or termination from the company. This includes but is not limited to time tracking records, clock-in/clock-out history, and any other relevant employment-related data captured by the application. Employees may request a copy of their data at any time, and the company is required to provide it in a timely manner.
